2. Applicability of These Terms

These Sale Terms govern the sale of products through the Site.

They apply in addition to our Terms of Use and Privacy Policy.

If there is any conflict between these Sale Terms and any other terms, these Sale Terms shall prevail in relation to purchases.

3. Products

We take reasonable care to ensure that product descriptions, images and information on the Site are accurate.

However:

  • packaging, labels or minor details may vary.

All products sold are food supplements and are intended to be used as part of a varied and balanced diet and healthy lifestyle.

Pomi-T® is a food supplement, not a medicinal product. It is not intended to diagnose, treat, cure or prevent any disease.

3.2 Availability

All products are subject to availability.

Where a product is temporarily unavailable, it may be offered on backorder.

In such cases, this will be clearly indicated on the product page or at checkout.

3.3 Pre-Orders

Certain products may be offered for sale on a pre-order basis.

Where a product is offered as a pre-order, this will be clearly indicated on the product page or at checkout.

Pre-order products are not immediately available for dispatch. Any estimated dispatch dates are provided for guidance only and are not guaranteed.

If we are unable to dispatch a pre-order within a reasonable time, you will have the right to cancel your order and receive a full refund.

We reserve the right to cancel a pre-order at any time, in which case a full refund will be issued.

The product label provides the recommended intake for Pomi-T®. You are responsible for using Pomi-T® in accordance with the label and, where relevant, with the guidance of your healthcare professional.

3.5 Country of Sale and Applicable Regulations

Pomi-T® sold through this Site is dispatched from our European Central Warehouse, operated by UAB Medgidas in Lithuania. Product specifications, labelling, and composition meet European Union food supplement requirements.

Where Pomi-T® is shipped to a destination outside the EU — including the United States, United Kingdom, and other countries — the product is offered for sale under EU specifications. You are responsible for confirming that Pomi-T® may be lawfully imported into your country and that its specifications are acceptable for your intended use.

Local product regulations, labelling requirements, or health claim restrictions in your country may differ from those in the European Union. We do not make any representation that Pomi-T® complies with the regulatory requirements of countries other than the European Union and the United Kingdom.

4. Orders

4.1 Placing an Order

By placing an order, you confirm that:

  • you are legally capable of entering into a binding contract;
  • all information provided is accurate and complete.

Your order constitutes an offer to purchase.

A binding contract is formed only when we confirm acceptance of your order.

4.2 Order Confirmation

After placing an order, you will receive an order confirmation email.

This email confirms receipt of your order but does not constitute acceptance.

Acceptance occurs when:

  • payment is received (for immediate-payment orders), or
  • payment is completed following a payment request (for pay-later or backorder orders).

5. Pricing

5.1 Prices

All prices are shown in USD ($) or EUR (€) depending on your location, and include VAT where applicable, unless stated otherwise.

Delivery charges, if applicable, are displayed at checkout before you complete your order.

5.2 Pricing Errors

In the event of a pricing error:

  • we reserve the right to cancel the order;
  • you will be informed and offered the option to reconfirm at the correct price or receive a full refund.

6. Payment

6.1 Payment Methods

We accept payment via the methods displayed at checkout (including card payments and digital wallets).

6.2 Pay-Later and Backorder Orders

For certain products or situations, we may allow orders to be placed without immediate payment.

In such cases:

  • your order will be placed on hold;
  • no payment will be taken at the time of order;
  • you will be contacted with a secure payment link when the order is ready for dispatch.

Payment must be completed before the order is shipped.

7. Delivery

7.1 Dispatch

Estimated dispatch times are provided for guidance only and are not guaranteed.

Orders containing backorder items will be dispatched once stock becomes available.

7.2 Delivery Addresses

Where available, we may allow orders to be delivered to more than one address.

Responsibility for providing correct delivery details rests with you.

7.3 International Delivery

Orders to the US, UK and EU are delivered with all applicable taxes included. Deliveries to other international destinations may be subject to:

  • customs duties;
  • taxes;
  • handling or brokerage fees.

You are responsible for all such charges and for ensuring that products may be lawfully imported into your country.

We are not responsible for delays, restrictions or refusals imposed by customs authorities.

8. Risk and Title

Risk in the products passes to you upon delivery.

Ownership of the products passes to you only once full payment has been received.

9. Right to Cancel (Consumer Rights)

9.1 Cooling-Off Period

If you are a consumer in the UK or EU, you have the right to cancel your order within 14 days of receiving the goods, without giving any reason.

9.2 Effects of Cancellation

If you cancel:

  • you must return the goods unused and in their original condition;
  • you are responsible for return shipping costs, unless the goods are faulty.

Refunds will be issued within 14 days of receiving the returned goods.

9.3 Exceptions

For hygiene and safety reasons, we reserve the right to refuse returns of:

  • opened or used food supplements,
  • unless they are faulty or not as described.

10. Returns and Refunds

Nothing in these Sale Terms affects your statutory rights in relation to faulty or misdescribed goods.

11. Limitation of Liability

To the fullest extent permitted by law:

  • We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or any matter that cannot be excluded by law.
  • Subject to the above, we shall not be liable for:
    • losses resulting from misuse of products;
    • indirect or consequential losses;
    • losses arising from failure to follow usage instructions;
    • losses arising from your decision to use Pomi-T® alongside other supplements, medications, or therapies, where you have not consulted a qualified healthcare professional;
    • losses arising from your reliance on general informational responses provided by our customer service in lieu of professional medical advice. Individual responses to food supplements may vary.

12. Force Majeure

We shall not be liable for failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to:

  • supply chain disruptions;
  • transportation delays;
  • regulatory actions;
  • acts of God.

13. Governing Law and Jurisdiction

These Sale Terms are governed by the laws of Republic of Lithuania.

Nothing in these Sale Terms limits your statutory rights as a consumer.

Disputes may be brought before:

  • the courts of Republic of Lithuania, or
  • the courts of your country of residence, where required by consumer protection law.

14. Severability

If any provision of these Sale Terms is held to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
